Forty seconds before the start of the third raceSHAMROCK ABANDONNE, ENTERPRISE FINIT SEUL LA TROISIÈME COURSE

NEWPORT, RI, le 17 sept. -.

Two minutes after the start of the third race

1930 America's Cup Oil on canvas 26” x 40” 1996 Harold S Vanderbilt’s J Class yacht Enterprise racing Sir Thomas Lipton’s Shamrock V. In the third race in hazy weather over a windward leeward course, Lipton won the start, but whilst Shamrock’s crew were concentrating on getting in the mainsheet, Vanderbilt put in a quick tack to clear his wind and went on to win.In all of my racing experience I have never had so many difficult questions arise under the Racing Rules in so short a time as at the start of this race. Three debatable questions presented themselves inside of 30 seconds before the start, each one of which required not only an immediate answer, but action in accordance therewith.

• First, had Shamrock V gathered "full headway" after tacking and thereby established her rights on the starboard tack ? Pro, she had been on the starboard tack for some time; contra, we were traveling at least three feet to her two.

• Second, assuming that the Challenger had gathered "full headway," could she claim the rights of an overtaken yacht? If not, we, as the leeward yacht, had the right-of-way and could force her over the line ahead of time. Pro, we were traveling faster than she; contra, the two yachts had not been "sailing the same or nearly the same course."

• Third, assuming Shamrock V to be the overtaken yacht, had she a right to bear down on us "to prevent the overtaking yacht from passing her to leeward" ? Pro, she could properly claim that she bore away to avoid crossing the line ahead of the gun ; the question of intent is important; contra, she actually did prevent us from passing to leeward by bearing away.

A photograph from the Edwin Levick Collection, taken by levick, of the Enterprise (right) and Shamrock V (left) during the third day of the International Yacht Race.Thoughts such as these went through my mind in rapid succession during those 30 seconds before the start, but the predominating one was to keep clear of the Challenger and take no chances of incurring a doubtful foul; we had two races to our credit and experience had proven that under existing conditions we were faster.

After due consideration, the consensus of opinion of our afterguard was that Shamrock V had "gathered full headway" within the meaning of the words as used in the rule, that she could not claim the rights of an overtaken yacht, and that as the windward yacht she had a right to bear away to prevent us from passing to leeward, provided she kept clear of us. In other words, Shamrock V was entirely within her rights in maneuvering as she did; we, on the other hand, had we so elected, could have forced her over the line ahead of the gun.
